A WORD OF WARNING ABOUT RECORD EXPUNGEMENT IN ARIZONA:
A review of a number of other attorney's websites indicates that, at least some of them are indicating that when your sentence is complete i.e. you have paid your fine, finished probation etc. they will file what is known a a Motion to Set Aside your conviction which is almost automaticly granted in misdemeanor cases. This DOES NOT erase record as a true expungement would. It can still be used against you as a prior conviction. Anyone looking in Arizona's Public Access Case Look-up will see that you were convicted, but that the judgment was set aside and the charges dismissed. Close to an expungement, but it will be visable to anyone looking close enough. Obviously, this can be a problem depending on your situation in life. We provide this explanation to make you aware that you cannot just pay a fine in the misdemeanor cases and then have your record completely erased. Click on Arizona's Set Aside Statute to view what the law actually says. Felonies can be set aside too, again with the same set of problems. There are, however, other issues to deal with in Felony cases such as getting your civil rights back. If you have questions in either of these areas please give us a call.
